Original Artwork

All original paintings offered by Jana Rae Fine Art are original works created by Jana Rae, unless otherwise stated in the individual product listing.

Each original painting is one of a kind. Variations in brushwork, texture, surface, and other handmade characteristics are part of the original artwork and are not considered defects.

Original paintings are sold unframed unless otherwise stated in the individual product listing.

Digital Prints

Digital print listings are for digital files only.

No physical artwork, printed product, or frame will be shipped when purchasing a digital print.

Each digital listing describes the file format, aspect ratio, compatible print sizes, and other materials included with the purchase.

Customers are responsible for selecting print dimensions compatible with the supplied aspect ratio and for arranging printing through their preferred home or professional printing service.

Digital Print License

Purchasing a digital print grants the purchaser a limited license to use and print the purchased artwork for personal use only.

You may print the artwork for your own personal use, including displaying the resulting prints in your home or other personal spaces.

You may not:

Resell or redistribute the digital files
Share the digital files with others
Upload the files to websites, file-sharing services, or other platforms for distribution
Sell printed copies of the artwork
Use the artwork on products for sale
Use the artwork for commercial advertising, branding, or promotional purposes
Alter the artwork and sell or distribute the altered version
Claim the artwork as your own
Use the artwork for any other commercial purpose without written permission

Purchasing a digital file does not transfer ownership of the copyright.

Copyright

All artwork displayed or sold through Jana Rae Fine Art remains protected by copyright.

The purchase of an original painting or digital print does not transfer copyright or reproduction rights to the purchaser.

The artist retains all applicable copyrights and reproduction rights.

Original artwork may not be copied, scanned, reproduced, distributed, published, or commercially used without written permission from the artist.

Pricing

Prices are subject to change without notice.

Any price change will not affect a purchase that has already been successfully completed.

Applicable shipping charges, when required, will be displayed or otherwise communicated as part of the purchase process.

Product Availability

Each original painting is unique and is available only while inventory remains.

Once an original painting has been sold, it will no longer be available for purchase as an original.

A digital print of an artwork may remain available even after the original painting has been sold.

Availability of a digital print does not mean that additional original versions of the painting exist.

Orders

Jana Rae Fine Art reserves the right to cancel or decline an order when reasonably necessary, including in cases involving:

Incorrect pricing or listing errors
Suspected fraudulent or unauthorized transactions
Payment processing problems
An original artwork becoming unavailable because of an inventory error
Other circumstances that prevent the order from being fulfilled

If an order is canceled by Jana Rae Fine Art after payment has been successfully collected, the applicable payment will be refunded.

Shipping

Original paintings are packaged carefully and shipped according to the Shipping & Digital Delivery Policy.

Shipping times provided by carriers are estimates and may be affected by circumstances outside the control of Jana Rae Fine Art.

Customers are responsible for providing a complete and accurate shipping address.

Shipping Damage & Loss

Original paintings are shipped fully insured.

Damage or loss occurring while an insured shipment is in the possession of the shipping carrier will be handled through the applicable carrier and shipping insurance claims process, as described in the Shipping & Digital Delivery Policy.

Customers must retain the artwork, shipping box, and packaging materials and provide requested photographs or documentation when necessary for a shipping claim.

Any reimbursement, repair, replacement, or other resolution resulting from carrier damage or loss will be subject to the applicable carrier and insurance claim process.

Digital Delivery

Digital products are delivered electronically.

Customers are responsible for downloading and safely storing their purchased digital files.

If you experience difficulty accessing your files or receive an incorrect digital file, please contact Jana Rae Fine Art for assistance.

Returns & Refunds

Purchases are subject to the Returns & Refunds Policy posted on this website.

Original artwork sales are final except as provided in that policy or where otherwise required by law.

Because digital products are delivered electronically and cannot physically be returned, digital purchases are final and non-refundable except where otherwise required by law.

Color & Display Variations

Every effort is made to photograph and display artwork as accurately as reasonably possible.

Colors may appear differently depending on your monitor, phone, tablet, screen settings, lighting, and other factors.

For digital prints, final printed results may also vary depending on the printer, ink, paper, print settings, print size, and professional printing service selected.

Normal variations between screen images and physical printed results are not considered defects.

Third-Party Printing

Jana Rae Fine Art does not control third-party printing companies or the equipment and materials customers use to print digital artwork.

Jana Rae Fine Art is not responsible for printing errors, color differences, cropping, paper quality, printer performance, or other issues resulting from a customer's printer or third-party printing service.

Customers are responsible for providing the printer with the correct file and selecting a print size compatible with the supplied aspect ratio.

Website Information

Every reasonable effort is made to provide accurate photographs, descriptions, dimensions, prices, file information, and other product details.

Occasional typographical, technical, or listing errors may occur. Jana Rae Fine Art reserves the right to correct such errors when discovered.

Limitation of Liability

To the extent permitted by applicable law, Jana Rae Fine Art is not responsible for indirect, incidental, or consequential losses arising from the use of this website, third-party services, shipping carriers, printing services, or use of purchased digital files.

Nothing in these Terms & Conditions is intended to exclude or limit rights or remedies that cannot legally be excluded or limited.
